WASHINGTON — A new bill that would provide consumers with more access to Viagra and other erectile dysfunction drugs will lose the nation’s top FDA agency, and could take a hit to health regulators if passed.
The law is the latest effort by a group of industry groups to make it easier to get the pills in the United States, the FDA says.
The legislation, which comes into force next month, would require drug companies to include in the list of drugs they sell under the brand names of Viagra and Levitra, which are approved by the FDA to treat erectile dysfunction.
Viagra, the brand name for a pill called sildenafil, is a popular drug used to treat erectile dysfunction. The drugs are sold in pill form and come in pill-sized packs, costing the consumer more than $100 for a three-month supply.
The drugmaker said it would not sell the drug in the United States until next week, when it will begin selling a similar version in the United States.
The measure would also apply to any generic drug sold by a major drug company, including erectile dysfunction drugs. In that case, it would be required to include information about how the drug works and what other drugs it may interact with.
The move could change, among other things, some of the federal government’s top law enforcement officials, said in a written statement. Some of those officials, including health officials at the agency, said they would not comment.
The agency’s head of public affairs, Steven Nissen, told the Associated Press that the new law would likely be considered in other countries. He noted that it has not yet been implemented in the United States.
Critics of the new drug plan said the change in terms could hurt the drugs’ quality or safety, particularly when the FDA has not taken into account other factors.
“What’s going on here is what’s happening in the pharmaceutical industry,” said Cindy Whitehead, a Sprout, Calif.-based company that makes the pills. “This is a serious industry problem. The FDA is watching this.”
The new drug law has been in place for several years, and has received criticism from many groups.
In February, the FDA warned that the new drug law could put more stringent rules on how drugs are distributed and how they are made, including requirements that drug makers give more than 10 months’ written notice of any drug’s potential impact on the health of consumers.
A drugmaker said it would not change the rules that were in place in 2006 because it had “no jurisdiction” over how the agency handles the distribution of the drugs. That meant that it could only handle FDA oversight of the drugmaker.

“This is just an update on the drugs and how they are made,” said Scott H. Schuette, a professor of law at the University of Texas Southwestern. “It’s not a huge change.”
He said the new drug law could lead to more competition and a larger market for the drugs. The drug companies said they would not comment on whether that will affect them.
The legislation could also affect other consumer groups who are affected by the new law, including the advocacy group for women, Planned Parenthood of South Carolina and the American Civil Liberties Union.
“The impact on the consumers is not immediate,” said Dr. Steven Nissen, a professor of law at the University of Texas Southwestern.
He said he expects the new law would be the first time the FDA has taken a more concrete position on the issue.
The FDA has said that it will take into account other factors in the future. If passed, it could be easier for the agency to respond to a growing number of lawsuits by women who say the drugs they’ve been taking are unsafe or even harmful to their health.
